Welcome to PhotoRestore (hereinafter “the Website” or “we”). These Terms of Service (hereinafter “the Terms”) are a legal agreement between you and PhotoRestore regarding your use of the Website and its related services. Please read these Terms carefully. By accessing or using the Website you agree to be bound by these Terms. If you do not agree with any part of these Terms, do not use the Website.

1. Service Description

PhotoRestore is an AI-based online platform for restoring and enhancing old photos. We provide the following services:

  • Old photo denoising and deblurring
  • Intelligent colorization of black-and-white photos
  • Photo super-resolution enhancement (upscaling and detail recovery)
  • Before/after restoration comparison

This platform is an independent product built on third-party AI models (models hosted on platforms such as Replicate). PhotoRestore has no official affiliation with the developers or hosts of those models.

2. Account Registration and Use

  • You must be at least 13 years old to register an account.
  • You agree to provide a true and accurate email address at registration.
  • You are responsible for all activity under your account. Please keep your login credentials secure.
  • We reserve the right to suspend or terminate accounts where suspicious activity is detected.

3. Acceptable Use and Prohibited Content

When using the Website you must not:

3.1 Strictly prohibited content

  • ⛔ Generate, upload or process photos containing pornography, nudity, sexual innuendo or obscene content
  • ⛔ Generate, upload or process photos involving minors in inappropriate content
  • ⛔ Use the service for face-swapping, deepfakes or any form of facial manipulation
  • ⛔ Generate, upload or process photos containing violence, gore, hate speech, harassment or abuse
  • ⛔ Upload or process photos that infringe others' intellectual property, privacy or portrait rights
  • ⛔ Use the service for any illegal purpose or in violation of applicable laws

3.2 Generally prohibited behavior

  • Unauthorized access, interference or disruption of the Website's systems or services
  • Automated use (crawlers, scripts, etc.) to call the service at scale
  • Reselling, sublicensing or unauthorized distribution of the service
  • Impersonating others, providing false information or engaging in fraud

We reserve the right to review uploaded content and, when violations are found, to:

  • Immediately delete the violating content
  • Suspend or terminate the relevant account
  • Report violations to the relevant authorities
  • Not refund consumed points or fees

4. Intellectual Property

4.1 Our intellectual property

All content on the Website, including but not limited to the design, interface, code, trademarks, logos and brand elements, is the intellectual property of PhotoRestore or its licensors and is protected by copyright and trademark law.

4.2 Your photos

  • The original photos you upload to the Website remain yours.
  • You grant us a limited, non-exclusive license solely to process your photos and deliver the restoration results.
  • We do not use your photos for public display, model training or commercial purposes.

4.3 Restoration results

Restored results generated by the service belong to you once the corresponding points have been consumed.

5. Points and Payment

  • The service uses a points system. Different restoration modes consume different numbers of points.
  • Points can be purchased through payment providers (Alipay, Creem, etc.). The price is as shown on the page at the time of purchase.
  • Purchased points are non-refundable unless otherwise provided by law (see the Refund Policy).
  • Points have no expiry date and are valid indefinitely.
  • Points are tied to your account and cannot be transferred.

6. Third-Party Services

The Website integrates third-party AI model platforms (Replicate) to process photos. We make no express or implied warranties about the availability, performance or results of these third-party services. Restoration results may vary depending on the quality, age and extent of damage of the original photo.

7. Disclaimer of Warranties

  • The service is provided “as is” without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose and non-infringement.
  • We do not guarantee that the service will be uninterrupted, error-free or completely secure.
  • To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages arising from the use of or inability to use the service.
  • We recommend you back up your photos yourself before using the service, as we are not responsible for lost or corrupted uploads.

8. Third-Party Links

The Website may contain links to third-party websites or services. These links are provided for your convenience only. We are not responsible for the content, privacy policies or practices of third-party websites.

9. Service Availability

We endeavor to keep the service continuously available but reserve the right to temporarily interrupt it for maintenance, upgrades or force majeure. We will provide advance notice of major service interruptions where possible.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. For significant changes, we will notify you via a site announcement or email. Continuing to use the service after changes constitutes acceptance of the revised Terms.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the People's Republic of China. Disputes arising from these Terms shall first be resolved through friendly negotiation; if negotiation fails, they shall be submitted to a court of competent jurisdiction.
